Complying Development Certificate

A CDC is a combined planning and construction approval, designed to fast-track building projects that meet a set of pre-determined standards. A CDC certifies that your chosen design and construction materials and methods comply with the National Construction Code and associated standards. If your project complies, it can skip the Development Application, making the approval much faster.

A Complying Development Certificate is authorisation to start building.

Council will assess your CDC application to ensure it:

  • Meets legislative requirements (Exempt and Complying Development Codes) 2008
  • Adheres to the Building Code of Australia
  • Meets BASIX commitments
  • Complies with relevant bushfire provisions
  • Complies with other CDC submission requirements

Your CDC application may find you need to submit documents with your application. These documents may include:

  • Home Owners Warranty – Owner/Builder Permit
  • Architectural Plans & elevations
  • Engineering details
  • Structural specifications
  • Schedule of building materials
  • Payment of contributions fees
  • Principal Certifying Authority (PCA) contract agreement.

Long Service Levy

A Long Service Levy is required where the value of the building or subdivision works is $250,000 or more. The Levy is calculated at 0.25% of the value of works, for example, if the value of works is $350,000, then a $875.00 levy is payable to the Long Service Corporation. Applicants need to pay the Long Service Levy directly to Long Service Corporation through their portal, visit www.longservice.nsw.gov.au

After accessing the Long Service Corporation Portal:

  • click on Levy Calculator (to the right hand side of the screen), type in the cost of building/construction works, then the levy amount will be calculated for you
  • click on Pay Now - you will be asked to Log into Service NSW. If you don’t have a log in, then you will need to create an account.

After paying the Long Service Levy, Council or your Certifier will need a copy of the receipt of payment. For Council, you will need to upload a copy of the receipt document to the NSW Planning Portal with your Construction Certificate Application or your Complying Development Certificate Application.

How to apply for your Complying Development Certificate

Step 1.Create an account

If you don't already have an account, create an account on the NSW Planning Portal

Step 2.Apply using the NSW Planning Portal

Go to the NSW Planning Portal and complete the online application for a Complying Development Certificate (CDC)

Step 3.Upload required documentation

Depending on the type of works or use, there will be certain documentation that you will be required to lodge with your application.

Step 4.Lodged for review

Once the application is submitted through the Portal, an initial review will be carried out to check the information provided is sufficient for Council to accept.

Where it is identified that further information is required before the application can be accepted, an officer will contact the applicant to request the further information or clarification. Once adequate information is provided, the application can be accepted.

Step 5.Application is sufficient and ready to be accepted

When the application has been reviewed and considered ready for lodgement, a quote will be forwarded to the payee as nominated by the applicant for payment of the associated fees.

Assessment of your application will not commence until the fees have been received by Council.

Step 6.Assessment of the application

Once fees have been paid, the application will be registered and go through the assessment process.
