Surrender of a Development Consent is the formal process of notifying Council that you wish to voluntarily relinquish the development approval previously granted for a specific project.
Council requires written notice to process the surrender of a consent per Section 4.63 of the Environmental Planning and Assessment Act 1979 No 203 - NSW Legislation and Section 68 of the Environmental Planning and Assessment Regulation 2021 - NSW Legislation
Once the Surrender of a Development Consent is processed and accepted, Council will provide an acknowledgement letter confirming that the Development Consent has been surrendered.
Surrendering the Development Consent permanently extinguishes all associated rights and obligations, meaning a new development application must be lodged for any future development to proceed.
Any requests for refunds of contributions/headworks charges if not already spent as per Councils adopted Infrastructure Contribution Plans and/or security deposit bonds will only be considered where the application has been formally surrendered and no works have commenced. If you have received a Construction Certificate (CC) or Notice of Commencement (NOC), your certifier will need to confirm in writing that no works have commenced.
